Conditions of Participation and Privacy Policy Sweepstakes “Cinema Cooperation – The Three Musketeers of D’Artagnan.”
1. object
1.1 These conditions of participation and data protection information regulate the participation in the sweepstake of NutriPur GmbH, Weststr. 35, 06126 Halle (hereinafter referred to as “NutriPur”) as well as the processing of personal data collected from or communicated by the participants.
1.2 By participating in the competition, participants accept these conditions of participation and data protection information.
2. eligibility and implementation of the competition
2.1 Persons who are resident in Germany and have reached the age of 18 are eligible to participate. Excluded are employees of NutriPur and their relatives, as well as all persons who are or were involved in the creation or handling of the sweepstakes and their relatives. Participation via sweepstake clubs as well as automated services is excluded.
2.2 The Sweepstakes will start at 6pm on 4/14/2023 and end at 5pm on 4/19/2023. To participate in the sweepstakes, the participant must comment under the sweepstakes post, like to tag three friends and follow NutriPur on the respective platform. Excluded from participation in the competition are comments that use offensive language, discriminatory, racist, youth-endangering content or have a negative reference to persons or companies.
2.3 NutriPur will raffle off fan packages for the film “The Three Musketeers of D’Artagnan” among all participants.
For this purpose, the winners will be named immediately after the draw, no later than 24.04.2023 by PN and asked to send a message with the address data (name, address and Facebook / Instagram username) via email. In the event that this information is not provided within 2 days, the prize will be forfeited and a new draw may be held.
2.4 Each participant may only enter the competition once. A violation of this will lead to the exclusion of the participant concerned from the competition. Participants who use unauthorized aids, attempt to manipulate the competition in any other way or violate these conditions of participation will also be excluded. NutriPur reserves the right to disallow and reclaim winnings in these cases, even retroactively.
2.5 The prize can only be redeemed once per person. Sale to third parties is not permitted.
3. handling of the lottery
3.1 Payment of the prize in cash, in kind, their exchange or transfer to other persons is not possible. A participant can renounce the prize. In this case, the prize is forfeited or the prize is redrawn.
3.2 In case of incorrect contact information (e.g. invalid address) NutriPur is not obliged to find out the correct address.
3.3 The prize will be sent to the winner free of charge within Germany.
4. disclaimer of warranty
NutriPur points out that the availability and function of the competition cannot be guaranteed. The competition may be terminated or removed due to external circumstances and constraints without giving rise to any claims by participants against the organizer, unless NutriPur is responsible for such termination or removal to the extent set forth in Section 5 “Liability”. This may include technical issues, rule changes, or decisions by platforms such as Facebook or Instagram if the Sweepstakes is hosted on or in connection with them.
5. liability
5.1 NutriPur’s liability for damages shall be subject to the following exclusions and limitations of liability, without prejudice to the other statutory requirements for claims under this Section 5.
5.2 NutriPur shall be liable without limitation if the cause of damage is based on intent or gross negligence.
5.3 Furthermore, NutriPur is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which enable the proper execution of the event in the first place and on the compliance with which the contractual partners regularly rely. In this case, however, NutriPur is only liable for the foreseeable damage typical for the contract. NutriPur is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
5.4 The above limitations of liability shall not apply in the event of injury to life, body and health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
5.5 Insofar as NutriPur’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organizer.

6.1 The collected data of the participants (first name, last name, address, email address, Facebook / Instagram username) will only be processed by NutriPur for the implementation of the competition and for the prize processing. The legal basis is Art. 6 para. 1 b) GDPR. The personal data will be passed on to the service providers entrusted with the processing of the prize (e.g. agencies, shipping service providers).
6.2 The personal data stored for the purpose of conducting the competition will be deleted after the competition has been completed.

7.1 Legal recourse is excluded. German law applies.
7.2 If individual provisions of these Conditions of Participation are invalid, this shall not affect the remaining provisions of these Conditions of Participation.
